CONTRACT SPECIFICATION
6. Contract description
The Works under the contract include the design and construction of the new railway freight Reception Yard in the station Rezekne II, including 2.5 ha site preparation, earthworks and railway subgrade, construction of 6 yard tracks, with usable length from 1028 to 1192 m, head-shunt, trap siding, and with 27 turnouts, buildings and structures, installation of telecommunication and power supply systems, including preparation works for signaling system, and integration of the new yard into the existing infrastructure of the station, and related works such as, road construction, environmental measures, public utilities and co-ordination and approval with local authorities. The Contractor shall perform the Works under the FIDIC "Conditions of Contract for Plant and Design-Build" (First edition 1999), and he shall complete the Works within 22 moths from the signing of the Contract. The Works Contract will be awarded on a lump-sum basis.
7. Number and titles of Lots
The Contract is not divided into Lots or parts.
CONDITIONS OF PARTICIPATION
8. Eligibility and rules of origin
Participation is open on equal terms to all natural and legal persons [participating either individually or in a grouping (consortium) of tenderers] of the Member States and the countries and territories of the regions covered and/or authorised by the Regulation or other specific instruments applicable to the programme under which the contract is financed (see also item 21 below). All goods provided for this contract must originate in these countries.
9. Grounds for exclusion
Tenderers must provide a declaration that they are not in any of the situations listed in Section 2.3 of the Manual of Instructions for External Relations contracts (available from the following Internet address: http://europa.eu.int/comm/europeaid/tender/gestion/index_en.htm).
10. Number of tenders
Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors whose subcontract's amount is above 5 % of the tender price) may submit only one tender for one or several lots. Tenders for parts will not be considered. Tenderers may not provide a tender for a variant solution in addition to their tender for the works required in the tender dossier.
11. Tender guarantee
Tenderers must provide a tender guarantee of EUR 200 000 when submitting their tender. This guarantee shall be valid for not less than 90 days from the deadline for submission the tender. The tender guarantee will be released to the unsuccessful tenderers when the tender procedure has been completed, and to the successful tenderer upon submission of performance guarantee and signature of the contract.
12. Performance guarantee
The successful tenderer will be requested to provide a performance guarantee of 10% of the contract value in euro when countersigning the contract. This must be delivered within 28 days after receipt by the tenderer of the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next lowest, compliant tender.

14. Tender validity
Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.
15. Maximum delivery period
The finished Reception Yard shall be delivered to the Employer within 22 months from the Commencement date.
SELECTION AND AWARD CRITERIA
16. Selection criteria
1) The Tenderer shall be a registered firm, company or Joint Venture/Consortium, consisting of two or more firms or companies, capable of carrying out the Works specified in the Employer's Requirements.
2) The average annual turnover of the Tenderer over the last three (3) years shall be of at least 7 million Euro (EUR).
3) The Tenderer shall have performed at least 2 railway construction contracts within the last five years. The experience shall include the design and construction of railway freight/ marshalling yards, including railway subgrade, drainage and track works.
4) The Tenderer shall demonstrate experience in design and installation of telecommunication system within the last five years. The experience shall include the design and installation of telecommunication system for telephone and radio communication, and data transmission. The Tenderer may specify the required experience in telecommunication system of his subcontractor, if the Tenderer intends to subcontract these works. Such experience of the subcontractor shall be specified in form 4.6.3.
5) The Tenderer shall demonstrate experience in design and construction of buildings and power supply systems, high and low tension networks including. The Tenderer may specify the required experience in power supply system and construction of buildings of his subcontractor, if the Tenderer intends to subcontract these works. Such experience of the subcontractor shall be specified in form 4.6.3.

18. How to obtain the tender dossier
The tender dossier is available from the Ministry of Transport of the Republic of Latvia, 3, Gogola Street, Riga, LV-1743 upon payment of USD 135 or LVL 80, which excludes courier delivery. It is also available for inspection at the premises of the Ministry of Transport.
