CONTRACT SPECIFICATION

6. Contract description
The contract will include the design and construction of new signalling system ready for operation (including interlockings, line blocks, level crossings, CTC central offices and appropriate power supply equipment) and related works such as trenching for cables, building refurbishment, environmental measures and utilities for the following railway sections: Ventspils – Jelgava – Krustpils; Daugavpils – Indra. The FIDIC “Conditions of Contract for Plant and Design – Build (1999 edition)”, and procurement conditions of the Instrument for Structural Policies for Pre-accession (ISPA) will be used for this Contract. The Contract will be awarded on a lump-sum.

CONDITIONS OF PARTICIPATION

8. Eligibility and rules of origin
Participation is open on equal terms to all natural and legal persons [participating either individually or in a grouping (consortium) of tenderers] of the Member States and the countries and territories of the regions covered and/or authorised by the Regulation or other specific instruments applicable to the programme under which the contract is financed (see also item 21 below). All goods provided for this contract must originate in these countries.
9. Grounds for exclusion
Tenderers must provide a declaration that they are not in any of the situations listed in Section 2.3 of the Manual of Instructions for External Relations contracts (available from the following Internet address: http://europa.eu.int/comm/europeaid/tender/gestion/index_en.htm).
10. Number of tenders
Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors whose subcontract’s amount is above 5% of the amount of “Basic price + all Option prices”) may submit only one tender for the whole works. The above – mentioned limit of 5% of the amount of “Basic price + all Option prices” does not apply to sub-contractors in charge of the earth works, equipment installation/dismantlement works, trenching/cabling works, building refurbishment/installation, geotechnical works. For such sub-contractors the sub-contract’s amount limit shall be 30% of the amount of “Basic price + all Option prices”. Tenders for parts will not be considered. Tenderers may not provide a tender for a variant solution in addition to their tender for the works required in the tender dossier.
11. Tender guarantee
Tenderers must provide a tender guarantee of EUR 500 000 when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties.
12. Performance guarantee
The successful tenderer will be requested to provide a performance guarantee of 10% of the contract value in euro when countersigning the contract. This must be delivered within 28 days after receipt by the tenderer of the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next lowest, compliant tender.
13. Information meeting and/or site visit
A mandatory information meeting will be held on 28 May 2004, at the conference room No 227 of Latvian Railways, 3 Gogola iela, Riga, LV-1547, Latvia. Mandatory site visit will be carried out from 24 to 27 May 2004.

14. Tender validity
Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

SELECTION AND AWARD CRITERIA

16. Selection criteria
• Average annual turnover in railway signalling over the past 3 years shall be not less than 30 million Euro.
• The tenderer shall have completed at least 2 projects of the same nature comparable to the proposed contract within the last five years.
• Experience in the design and installation of different signalling equipment, including solid state interlocking for railway stations, Centralized Traffic Control system, level crossings, Line Block systems, and experience in adaptation of signalling systems to specific requirements of different railways.
• Suitable experience and proven qualifications of the key personnel in railway design and construction shall be of at least 5 years.

Proof of payment will be required before the issuance of the tender documents.
